The IRS Can and Will Read Your Email

Essex & Associates::www.essexinc.biz                November 15, 2011

Greetings!

Can the IRS access your emails? Yes, Yes and Yes.

1.) If they are older than six months old.

2.) If you to turn them over voluntarily.

3.) If they subpoena them.

This law requires the government to have a warrant to obtain e-mails that are less than six months old.

No warrant is required for emails that are older than that. Under the Stored Communications Act, the government (including the IRS) can look at your emails without a warrant as long as they are six months back or older.

The IRS can issue subpoenas for emails less than six months old.

Word to the wise: Do not ever put anything in an email that you potentially would not want the world (including the IRS) to know about.

Wishing you many happy returns,
